A bill to amend 1931 PA 328, entitled

"The Michigan penal code,"

(MCL 750.1 to 750.568) by adding section 411t.

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 SEC. 411T. A PERSON SHALL NOT USE THE INTERNET OR A TELE-

2 COMMUNICATION SYSTEM OR OTHER ELECTRONIC SYSTEM OR DEVICE SO AS

3 TO DISRUPT THE FUNCTIONS OF THE PUBLIC SAFETY, EDUCATIONAL, COM-

4 MERCIAL, OR GOVERNMENTAL OPERATIONS OF THIS STATE WITH THE INTENT

5 TO COMMIT AN OFFENSE PROHIBITED UNDER CHAPTER LXXXIII-A. A

6 PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A FELONY PUNISHABLE

7 BY IMPRISONMENT FOR NOT MORE THAN 20 YEARS OR A FINE OF NOT MORE

8 THAN $100,000.00, OR BOTH. AS USED IN THIS SECTION:

9 (A) "COMPUTER", "COMPUTER NETWORK", "COMPUTER PROGRAM",

10 "COMPUTER SYSTEM", "DEVICE", AND "INTERNET" MEAN THOSE TERMS AS

11 DEFINED IN SECTION 145D.

1 (B) "ELECTRONIC SYSTEM" MEANS A SYSTEM RELATING TO

2 TECHNOLOGY HAVING ELECTRICAL, DIGITAL, MAGNETIC, WIRELESS, OPTI-

3 CAL, ELECTROMAGNETIC, OR SIMILAR CAPABILITIES. ELECTRONIC SYSTEM

4 INCLUDES, BUT IS NOT LIMITED TO, A COMPUTER SYSTEM OR COMPUTER

5 NETWORK, OR DIGITAL BROADCAST SYSTEM, OR SATELLITE NETWORK.

6 (C) "TELECOMMUNICATION SYSTEM" MEANS SERVICES OFFERED TO

7 CUSTOMERS FOR THE TRANSMISSION OF 2-WAY INTERACTIVE COMMUNICA-

8 TIONS AND ASSOCIATED USAGE.
